Testimony: B.A.W.

 Name:  B.A.W.
 Age:  16
Date of incident:   6 April 2015
 Location:  Al 'Arrub, West Bank
 Accusation:  Throwing stones/Molotovs

On 6 April 2015, a 16-year-old minor from Al 'Arrub refugee camp was arrested by Israeli soldiers from home at 2:30 a.m. and accused of throwing stones and Molotov cocktails. He reports being informed of his right to silence but not consulting with a lawyer prior to interrogation. He reports being released without charge nearly 12 hours after his arrest.

I woke up to the sound of Israeli soldiers trying to break down our front door. It was around 2:30 a.m. When the soldiers entered our home my father came to my bedroom to tell me they wanted to arrest me.

The soldiers told my father they were going to take me for questioning at Etzion settlement but they didn’t tell him what they were going to question me about. When he asked they told him there wasn’t any specific accusation. They gave my father a form with details about my arrest. The form itself was printed in both Hebrew and Arabic but the information they wrote down was only in Hebrew. They marked Etzion on the form to indicate I was going to be taken to Etzion.

I was told to get dressed and then the soldiers took me outside where my hands were tied to the front with three plastic ties: one on each wrist and one connecting the two. The ties were not painful. The soldiers walked me for about 10 minutes towards the main road and made me wait for about 15 minutes until a troop carrier arrived. I was put in the back of the carrier and made to sit on the floor.

The carrier drove for about 30 minutes before it stopped at the Israeli police station inside the settlement of Kiryat Arba. I was taken inside to see a doctor who examined me. I was then taken back to the carrier where I sat on the floor.

Half-an-hour later the carrier drove for about 30 minutes before stopping at the settlement of Etzion. At Etzion I was taken to a room where I waited until around 7:00 a.m. I was then taken to a courtyard where I sat on the ground in the sun until around noon when an interrogator came for me.

The interrogator wore civilian clothes. He told me his name was "Moshe". Before he started to interrogate me he told me I had the right to remain silence and the right to see a lawyer. I told him I didn’t know any lawyers. I did not speak to a lawyer.

The interrogator then accused me of throwing stones and Molotov cocktails. I told him to provide me with one single piece of evidence and then I would confess. He never presented any evidence. He told me he brought me in because he wanted to get to know me. He then named some boys and asked me to confess against them. I told him I didn’t know any of the boys he mentioned.

The interrogation lasted for about an hour. He typed what I was telling him on a computer but he did not print anything out or ask me to sign anything. I think he just wanted to get some information from me about other boys in the camp. I was tied the whole time.

At around 1:00 p.m. he took me outside to the courtyard and made me sit on the ground. About an hour later the interrogator removed the ties and told me I was released. I left Etzion at around 2:00 p.m. and I walked for about an hour until I got home.
